What You Do in the First 72 Hours After a Car Accident Can Make or Break Your Case

1. Seek Medical Attention — Even If You Feel Fine
Not all injuries show up right away. Conditions like whiplash, concussions, and internal bleeding often surface hours or even days later. Why it matters: Medical records help link your injuries to the accident. Insurance companies may claim your injuries weren’t serious if you delay treatment. Always go to the ER or urgent care and follow up with your primary care doctor.
2. Gather Evidence at the Scene
If you are able, gather as much documentation as possible at the scene of the crash. Be sure to collect the following: photos of vehicle damage, road conditions, skid marks, and any visible injuries; contact information for the other driver and any witnesses; and notes about the time of day, weather conditions, traffic signals, and exact location. This type of evidence can be crucial in establishing fault or challenging an inaccurate police report.
3. Request a Police Report
Even in minor collisions, call the police and request an official report. Don’t let the other driver talk you into handling it “off the record.” Why it's important: Police reports include objective details and may assign fault. They’re valuable evidence for insurance and legal claims.
4. Don’t Talk to the Other Driver’s Insurance Company Without a Lawyer
You may receive a call from the at-fault driver’s insurance company requesting a statement. Don’t give one. Protect yourself by avoiding any admission of fault, not downplaying your injuries, and declining to provide a recorded statement. Instead, politely refer them to your attorney. Keep in mind that their goal is to protect their company’s bottom line—not to help you.
